Is it possible for a seaman becomes entitled to severance pay if he gets arrested?

If a seaman gets arrested, he can not become entitled to severance pay.

In accordance with Subparagraph I of Article 14 of Maritime Law numbered 854 if the contract is canceled by the employer due to reasons other than those stated in this Article, the seaman becomes entitled to severance pay. Getting arrested is among the reasons stated in Subparagraph I of Article 14 of this Law.
